Clinton Calls Trial of Aung San Suu Kyi Outrageous

Clinton Calls Trial of Aung San Suu Kyi Outrageous
By David Gollust
State Department
20 May 2009

U.S. Secretary of State Hillary Clinton Wednesday called the Burmese government's trial of Aung San Suu Kyi outrageous, and said its treatment of the democracy leader will render the country's planned elections next year illegitimate.

Clinton's comments on Burma, in two Senate hearings Wednesday on the State Department budget, were the strongest to date by the Obama administration on the latest prosecution of Aung San Suu Kyi.

The dissident figure, who has been under varying forms of detention most of the time since 1990, faces a possible five-year prison term for a bizarre incident earlier this month in which a U.S. citizen swam across a lake and entered the villa in central Rangoon where she is under house arrest.

Clinton said United States rejects the charge that Aung San Suu Kyi violated terms of her house arrest. She said the United States is trying to mobilize international pressure for her early release but acknowledged that prospects for persuading the reclusive military government to change course are uncertain.

U.S. Secretary of State Hillary Clinton on Capitol Hill, 20 May 2009
"We don't know whether we will have any success in convincing them otherwise," said Hillary Clinton. "But it is outrageous that they are trying her, and that they continue to hold her because of her political popularity. And they intend to hold elections in 2010, which from the beginning will be illegitimate because of the way they have treated her."

Aung San Suu Kyi's National League for Democracy Party won national elections in 1990 but was barred by the military from taking power.

The 2010 elections will be the culmination of a so-called road map to democracy engineered by the government which excludes Aung San Suu Kyi, the 1991 Nobel Peace laureate, and would leave the military in control of key levers of power.

Clinton has discussed the issue with a number of Asian leaders including the secretary-general of ASEAN, the Association of Southeast Asian Nations, and told senators she is heartened by the regional response though she did not elaborate.

She said she hoped the baseless trial of Aung San Suu Kyi will end with her speedy release and the restoration of a role by her and her party in the country's political life.

CLOSED DOOR TRAIL AND UN TOP HEAD WILL GO TO BURMA SOON

The regime had unexpectedly opened up the hearing at the notorious Insein prison on Wednesday in an apparent concession to fierce international criticism of the charges against the Nobel Peace Prize winner.

But it clamped down again Thursday, despite a warning from US Secretary of State Hillary Clinton over the regime's "outrageous" treatment of the democracy icon and a pledge by UN chief Ban Ki-moon to visit the country.

"The press will not be allowed today. Only for one day were diplomats and press allowed," a Burma official told AFP on condition of anonymity.

About 30 members of her National League for Democracy party, including the country's former longest serving political prisoner, Win Tin, kept up a vigil outside the prison as the trial resumed, witnesses said.

Aung San Suu Kyi faces up to five years in jail if convicted of charges of breaching her house arrest, which stem from an incident earlier this month when an American man, John Yettaw, swam to her lakeside house.

A smiling, healthy-looking Aung San Suu Kyi, 63, had thanked diplomats for coming to the trial on Wednesday and said she hoped to meet them again in "better days."

Authorities allowed one diplomat from each of the 30 foreign embassies in Rangoon to attend the proceedings on Wednesday along with 10 journalists from local and foreign organisations.

Aung San Suu Kyi later met envoys from Thailand, Singapore and Russia, expressing hope that "it was not too late for something good to come out of this unfortunate incident," a Singapore government statement said.

UN TOP HEAD
BAN KI-MOON
WILL GO TO
BURMA SOON

Critics say the junta wants to keep her locked up ahead of elections planned for next year under a controversial "roadmap to democracy" that enshrines a role for the military in government.

In Washington, Clinton said the regime's treatment of Aung San Suu Kyi would automatically make the polls "illegitimate because of the way that they have treated her."

She added that it was "outrageous that they are trying her and that they continue to hold her because of her political popularity and they intend to hold elections in 2010."

UN chief Ban said he was "deeply concerned" about the situation in Myammar and said he would bring up the issue with junta leader Senior General Than Shwe.

"I'm going to visit Burma as soon as possible. Now I am very serious in discussing with (the) government of Burma when I could be able to visit Burma," he told CNN.

A western diplomat in Rangoon said however that the regime's strategy in the past had been to make as few concessions as possible when faced with international outrage, and then close up again when the pressure eases.

The junta did the same amid global anger over its crackdown on monk-led prote

sts in 2007 and its handling of the aftermath of Cyclone Nargis in 2008, the diplomat said.

The regime refused to recognise a landslide victory by Aung San Suu Kyi's party in the last elections to be held in Burma in 1990. The military has ruled Burma since 1962.

US intruder said Myanmar's Suu Kyi 'scared'

An American who swam to the house of Myanmar democracy icon Aung San Suu Kyi said that she seemed "scared" of him, her trial heard Thursday as the junta again barred media and diplomats from the court.

Aung San Suu Kyi has been charged with breaching her house arrest

Police at the trial played video footage that John Yettaw had filmed of himself inside the 63-year-old's lakeside home, where he spent two days earlier this month, said a spokesman for her National League for Democracy party.

Yettaw's bizarre intrusion led to Aung San Suu Kyi being charged with violating her house arrest, in a case that has provoked international outrage and calls for Myanmar's military regime to free her immediately.

"There was no other person except Yettaw himself in the video. He said that he had arrived at Aung San Suu Kyi's house," said NLD spokesman Nyan Win, who was inside the trial at the notorious Insein prison near Yangon.

The video showed the burly Yettaw standing in front of a picture of Aung San Suu Kyi's father, General Aung San, the country's independence hero, and speaking to the camera, Nyan Win said.

"He said he had asked her for permission to take photos, but she refused. She seemed scared, so he said he felt sorry because of that," he said, adding that the video lasted about two hours and was translated into Burmese.

Yettaw, 53, and two female political aides who live with Aung San Suu Kyi are also on trial.

Myanmar authorities had unexpectedly allowed diplomats and journalists to attend the trial for the first time on Wednesday, but abruptly announced on Thursday that the hearings would be back behind closed doors again.

A smiling, healthy-looking Aung San Suu Kyi had thanked diplomats for coming on Wednesday and said she hoped to meet them again in "better days." Footage of her was later shown on state television.

She later met envoys from Thailand, Singapore and Russia, expressing hope that "it was not too late for something good to come out of this unfortunate incident," a Singapore government statement said.

The regime has kept the Nobel Peace Prize winner in detention for 13 of the past 19 years. It filed the charges against her just weeks before a May 27 deadline when her latest six-year spell of detention expires.

Critics say the junta wants to keep her locked up ahead of elections planned for next year under a controversial "roadmap to democracy" that enshrines a role for the military in government.

The regime's opening up of the trial had appeared to be a small concession to mounting global anger, but in Washington, US Secretary of State Hillary Clinton said its treatment of Aung San Suu Kyi was "outrageous".

Clinton said the regime's treatment of Aung San Suu Kyi would automatically make the 2010 polls "illegitimate because of the way that they have treated her."

UN chief Ban Ki-moon meanwhile said he was "deeply concerned" about the situation in Myanmar and said he would bring up the issue with junta leader Senior General Than Shwe.

"I'm going to visit Myanmar as soon as possible. Now I am very serious in discussing with (the) government of Myanmar when I could be able to visit Myanmar," he told CNN.

Leading international jurists called for the UN Security Council to follow the precedent of Rwanda and the former Yugoslavia and hold an inquiry in Myanmar, saying the regime could be guilty of crimes against humanity.

"With Burma, there has been no such action from the UN Security Council despite being similarly aware of the widespread and systematic nature of the violations," said the report published by Harvard Law School, using Myanmar's former name.

The regime refused to recognise a landslide victory by the NLD in the last elections to be held in Myanmar in 1990. The military has ruled Myanmar since 1962.

Anniversary

30 May Demonstration Solidarity

Memorial Day Weekend in the United States of American is a day when we remember the fallen that’ve died fighting for our freedom and democracy. These men and women pray the ultimate price so future generations could live with liberty. They are the heroes of our nation. Burma is a land full of heroes that died for the sake of freedom and democracy. The innocent villager who killed while tending his crops is a hero as well fore he died in the service of his family. Both the freedom fighter and the farmer share one desire and that’s only to be free.
For those who don’t know about the Depaeyin Massacre, on 30 May 2003, 2 miles outside of Depaeyin Township a junta lead mob of about 5,000 of anti-NLD protesters assaulted Aung San Suu Kyi’s convoy and a crowd of NLD supported killing hundreds of innocent people. With bamboo sticks organized thugs beat and maimed unarmed supporters who came to listen to Daw Aung Suu Kyi. Government officials directed the assault while police assisted the attackers in this needless blood bath.
Later after the assault police arrested all the survivors including Daw Aung Suu Kyi who was the actual target of this thinly masked assassination attempt. In the bloody aftermath 80 or more NLD members and associates where beaten to death and disfigured in this ghoulish and barbaric junta staged ambush. Everybody who died on that fateful day died for democracy and many died protecting Aung San Suu Kyi. Ironically, America’s Memorial Day falls on 30 May as well.
America’s freedom and democracy was hard fought and many sacrifices were made so future generations could live in a land with liberty and freedom. Our democracy is fiercely guarded and we’ve taken full responsibility for its protection and preservation. American’s all have a stake our democracy fore we are vigilant and know that we may have to pay the ultimate price once again.
At this juncture in time Burma is poised to make history. The dynamics of the current situation in Burma is at a breaking point. It is inevitability and Burma’s future to alter its destiny. The bonds that restrained her have long since rotted away and can no longer repress the desire to be free. Burma is enslaved by an illusion and random acts of tyranny designed to give the illusion of absolute control when in reality it masks the junta’s fear. The junta fears Aung San Suu Kyi fore she has rallied 10’s of millions of people where the military junta has only rallied a fraction of the population. The junta is outnumbered 80/20 in the population and that does not include cease fire groups. It is time for the Fighting Peacock to awaken; it is time for Burma to be free and it is time Daw Aung Suu Kyi is freed from bondage as well as all the political prisoners.
30 May is more than a demonstration it’s a show of solidarity. The eyes of the world are on Burma like never before. Wearing white and gathering in tea shops for peaceful demonstration will show the world that democracy is still in the hearts of Burmese the people. To stand in peaceful demonstration is to stand along side Daw Aung Suu Kyi letting her know she is not alone and her sacrifice is not in vane.

Demonstration in Burma May 30th

Demonstration in Burma May 30th
by buffalohair
20 May 2009

Pro Democracy activists inside Burma what the world and their fellow countrymen to know that May 30th is the day the Fighting Peacock will arise in a National Demonstration. The world must know that the trial being held in Burma is a violation of Burma’s law. Than Shwe is making a mockery of his own rules in an effort to “fix” the illegal election on 2010 with his paranoid attempt to silence Aung San Suu Kyi.

Symbolically May 30 marks the 6 year anniversary of the Depaeyin Massacre when the military junta tired to assassinate Daw Aung Suu Kyi. Fortunately she survived only to be placed under arrest. But for hundreds of her followers their fate was met with bloodshed since they were beaten to death by junta thugs.

Sources within Burma request that in a show of solidarity that everyone wear white and gather at tea shops. Suggested places to gather are Shwedagon Pagoda, Hledan Junction and Insein Prison. Daw Aung San Suu Kyi stands defiant and strong and has urged that the people overcome their fears. Freedom From Fear and a show of support by the people of Burma will show the world that the flame of democracy still burns brightly in the hearts of millions. The people of Burma call for Ban Ki-Moon to personally engage this growing crisis at this juncture. What is happening to Aung San Suu Kyi is a criminal offence and a violation of human rights and it is time for the UN and the world to make a stand on this issue.

The National League for Democracy clearly does not agree with the premise of this sham trial do to its unconstitutionality and blatant criminality. They urge world leaders to demand a public and open trial at the very least.

For the riot police, soldiers and generals within Burma it is time for you to stand by your people and stand for freedom against tyranny and fear. You can’t murder your own people in order to keep the peace when it is the military junta who has declared war on its own citizens. You can’t be a party to crimes against humanity any longer. The junta is moving troops into position as of this writing. The people of Burma ask their soldiers to stand with them instead of against them on this historic day or remembrance and not repeat the travesties Than Shwe perpetrated on his own people.

If a crisis arises from this peaceful demonstration it is urges that the pro democracy leaders inside of Burma assume their leadership roles that has been prescribed to them. The man of steel, U Win Tin, has been at the gates of Insein Prison from the onset in support of Daw Aung San Suu Kyi. Exercising Freedom From Fear he stands with thousands of other citizens so that Aung San Suu Kyi does not stand alone. Freedom From Fear means freedom from tyranny and repression.

Daw Aung San Suu Kyi is a victim of a heinous crime and it is being perpetrated before the eyes of the world. With raw courage she defiantly stands up to the junta and it is time for Burma to stand up for Daw Aung San Suu Kyi.

By request of pro democracy activists it is requested that this message be spread around the world so everyone will be aware that the cause for freedom and democracy is not dead but very much alive. It is time for Ban Ki-Moon, the UN and the world to get involved and demand that Aung San Suu Kyi be released from this criminal detention. It is time to take a stand for the people of Burma and the duly elected leader of this enslaved nation.

London Demonstration In front of Burmese Embassy

Sri Lanka and Burma top of the agenda in Brussels (18/05/2009)

Sri Lanka and Burma top of the agenda in Brussels (18/05/2009)

Foreign Secretary, David Miliband, joined other EU foreign ministers in Brussels for the General Affairs and External Relations Council (GAERC) meeting. The main items on the agenda were the humanitarian crisis in Sri Lanka and the trial of Burma's opposition leader Aung San Suu Kyi.

The foreign ministers said they were 'appalled by the loss of innocent civilian lives' as a result of the conflict in Sri Lanka and called on the Government and the LTTE to 'take all necessary steps to prevent further loss of life'.
During 2008, the human rights situation in Burma deteriorated even further. At the end of 2008, harsh sentences were given to over 200 democracy activists.

Burma's citizens continue to be denied of almost all fundamental rights, including the ability to have any say in the country's future.

Suffering in Burma caused by the regime's economic mismanagement was made more acute by the effects of the devastating cyclone Nargis in May 2008.

Political prisoners

The overall number of political prisoners held in Burma increased sharply during 2008. Many political prisoners detained during, or following, the 2007 protests were brought before secret tribunals on a range of charges, many receiving severe sentences and dispersed to prisons in remote areas, where conditions are poor and they are unable to draw on the support of their families.

Former student activists who had led the 1988 protests – for which they had already served lengthy prison terms – were detained once again in August 2007, and have recently been sentenced to 65 years each. Many monks, lawyers, bloggers and members of the artistic community were also given lengthy sentences.

The overall number of political prisoners in Burma has increased by around 1,000 over the past year.

Daw Aung San Suu Kyi remains under house arrest.

The overall picture remains bleak. It is estimated that over 2,000 political prisoners remain in detention. The regime has resisted all calls for an accurate accounting of those held and the International Committee of the Red Cross has not been permitted to visit any political prisoners since 2005.

Ethnic minorities

Many ethnic minority communities and religious groups in Burma are discriminated against, through failure to protect or respect their cultures and languages, and their inability to practise non-Buddhist religions.

In the west of the country the Muslim Rohingya face a range of restrictions on their freedom to travel, marry, study or practise their faith.

The Burmese army's regular campaigns in Karen State have left many villages destroyed, causing a significant level of internal displacement.

Many members of the Chin community living on the border with India are currently enduring a famine caused by a plague of rats, a phenomenon that affects the region every 50 years but for which the regime had made no preparations.

The FCO emphasise regularly to the Burmese regime, and to countries in the region, the need for the full and fair participation of ethnic nationalities in the political process as key to a durable solution to Burma's problems.

Regime roadmap

The Burmese regime has pressed ahead with its political 'roadmap' and resisted all calls to make the process more open and inclusive. On 10 May, 8 days after Cyclone Nar y y gis devastated the Irrawady delta, a referendum on a new
constitution was held.

After an international outcry, the poll was postponed in the cyclone-affected areas until 24 May. There were numerous reports of voting irregularities and the final result lacked all credibility. The next step in the process will see 'elections'
held in 2010, which according to the government will result in the emergence of a 'disciplined democracy'.

Efforts by the UN during the course of 2008 to obtain the release of political prisoners and dialogue between government and opposition were consistently rebuffed.

Forced labour
The Burmese government have passed a law banning forced labour and the recruitment of individuals under the age of 18. The International Labour Organisation (ILO) still faces an enormous challenge in eliminating forced labour perpetrated by the military and officials at a local level.

Humanitarian

On 2 May 2008, Cyclone Nar y y gis devastated the Irrawaddy delta area and Rangoon, killing some 130,000 people and left thousands more without shelter, land, or any source of food or income.

Pakistan calls for release of Myanmar’s Suu Kyi

ISLAMABAD: Pakistan on Tuesday lamented the trial of Myanmar pro-democracy leader and Nobel peace laureate Aung San Suu Kyi and called for her swift release, AFP reports.

Aung San Suu Kyi, 63, is on trial at the notorious Insein prison outside Yangon, facing up to another five years’ detention on charges of harbouring an American man who swam to her home.
Foreign Minister Shah Mahmood Qureshi described the trial as ‘unfortunate’and urged the Myanmar government to consider reviewing its decision.
Aung San Suu Kyi has spent 13 of the last 19 years in jail or under house arrest at the hands of Myanmar’s generals, most of it at her lakeside house in Yangon.
‘Her early release would serve the fundamental interests of Myanmar with which Pakistan enjoyed close cooperative relations,’ said Qureshi.
The military has ruled Myanmar, formerly known as Burma, since 1962 and has refused to recognise her party’s landslide victory in 1990.

China hopes Myanmar can realize reconciliation

BEIJING, May 19 (Xinhua) -- China hopes Myanmar can realize reconciliation, stability and development through dialogues of all parties, Foreign Ministry spokesman Ma Zhaoxu said here Tuesday.
Ma made the remarks when answering a question concerning Myanmar opposition leader Aung San Suu Kyi at a regular press briefing.
Suu Kyi is on trial, charged with accommodating and speaking to an American named John William Yettaw, who sneaked into her restricted house on May 3.
If convicted, Suu Kyi would face five years of imprisonment and an automatic extension of her current term of house detention since 2003.
"Myanmar's affairs should be decided by its people. As a neighbor, China hopes Myanmar can realize reconciliation, stability and development through dialogues of all parties," said Ma.
The Obama administration of the United States has extended economic boycott against Myanmar last week and voiced its concerns over the health of Suu Kyi, urging her immediate release out of the house arrest.

Touchy Email

Dear Jenifer

Hope this email finds you well and happy. Thank you for your emails. Really appreciate them.

I am sure many people would be very angry and emotional about Daw Aung Su Kyi being put in the Insein prison and blaming Mr Yettaw as a fool, who has caused all these troubles.

In my opinion, it might be a blessing in disguise. Nothing has been happening for a while, and then suddenly this has happened, and the whole world is giving attention to Burma again through imprisonment of Daw Su and Mr Yettaw swimming to her residence.

In my view, all the leading group for Burma, inside and abroad, should grab this opportunity and make the most out of it by mass movement of the people inside and outside Burma. All the groups abroad should unite, and in one combined force with one voice, request the UN, USA, European Union, France, UK, Germany, Australia and Canada to put more pressure on the military regime. If possible, physical intervention by UN or other forces. We should re-activate the “Right to Protect” clause to prepare psychologically for the world bodies to act strongly. No harm to put these in the forefront of our requests.

Daw Su may be suffering. But this is the fight for freedom from the military regime. As such, there are expensive prices to pay. There will be a lot of suffering. Nelson Mandela went through many suffering before he was freed. If I may suggest, anger and emotions are not much useful if we want to topple the military regime. It would be wise to keep our minds calm, and to think rationally about the opportunities that situations like this might present. It will also be wise to think ahead of the military regime, so that we are not trapped in their game strategy.

In my view, the military regime, by arresting and imprisoning Daw Su, has made a big strategic mistake. They are claiming that their constitution and the election in 2010 are legitimate, fair and have been done properly for the best interest of the nation. This incidence has shown that the laws imposed by the military regime are nothing but dictatorial, unfair, unjust and for the interest of the military regime to prolong their power. And by revoking the licence of one of the lawyer for Daw Su, U Aung Thein, only shows that the military laws are a sham and the military court is nothing more than a Kangaroo court. They don’t follow proper laws. Never have been. We must stress this point.

I would not be surprised if Daw Su demands that she be freed and the military regime should hand over the government to her party NLD, because the laws that imposed on her to house detention and now in Insein prison are not legitimate. They are not from the people, and not from a legitimate government. We are not required to act like little boys and girls who are afraid of breaking the military regime’s unjust laws. As they are unjust laws, they have to be broken. We can say that, Mr Yettaw, regardless of who he is and how he gets there, he is to be welcomed as a guest, especially as he has swam for hours. Being not a young person, he would be very tired and would be inhumane to ask him to swim back straight away. He would need to recover for quite sometime – even days. It is the military regime’s business to cover the grounds if they don’t want anyone to come and visit Daw Su. The onus is on them. The finger should be pointing at them, and not Daw Su. If the military regime has framed it, it is a big mistake for them. They have forgotten to put the velvet gloves on their iron fists by doing things in a haste through hatred for Daw Su. It reveals the world about the naked truth of the military regime. By this event, they have disgraced themselves in front of the whole world, and discredited their claim that the 2010 election would be fair and legitimate.

This situation has given an opportunity to the groups of Burmese leaders inside and outside Burma, to unite and make the most of it, calmly and with strategic movements in mind. All forces to unite including Chin, Kachin, Shan, Karen, Kareni, Mon, Arakanese, Kaya, Wa, Myoung, and others, regardless of religions or tribes. If we want to succeed, we need to stay calm and patient. It can be a long haul. One thing is certain, no one can kill the wishes of the people, no matter how much guns they have.

Please take care and hope you have a pleasant and a calm day.

Best regards

Zor Hane
