Ban Ki-moon will meet NLD representatives

Date: 02 Jul 2009

By WAI MOE
UN Secretary-General Ban Ki-moon will meet representatives of Burma's opposition National League for Democracy (NLD) during his two-day visit to Burma, beginning on Friday. It is still not clear, however, whether the Burmese regime will accede to the UN chief's wish to also meet detained pro-democracy leader Aung San Suu Kyi.
NLD spokesman Nyan Win told The Irrawaddy on Thursday that five representatives of the party will meet Ban. The Burmese authorities had approved of a meeting but had not yet set a time, Nyan Win said.
The NLD spokesman said he did not expect Ban's visit to Burma would have any large impact on efforts to bring about positive changes.
The NLD's executive committee discussed Ban's upcoming visit on Wednesday.
Ban is scheduled to arrive in Rangoon on Friday and then travel to the capital, Naypyidaw, for a meeting with junta head Snr-Gen Than Shwe and other top generals the same day.
Ban is now in Japan, where he met on Wednesday with Japanese Prime Minister Taro Aso.
After the meeting, Ban told reporters he would try to use his visit to Burma "as an opportunity to raise [in the] strongest possible terms and convey the concerns of the international community to the highest authorities of government."
He said "three of the most important benchmarks would be, first of all, they should release all political prisoners, including Daw Aung San Suu Kyi."
Ban said he would also tell the junta that the resumption of dialogue with the opposition was a necessary part of the national reconciliation process and he would urge the regime to create conditions conducive to credible elections in 2010.
Ahead of Ban's trip to Burma, the New York-based Human Rights Watch said on Wednesday that the UN chief should press the junta to release all political prisoners and to engage in dialogue with the opposition. Ban should not give legitimacy to the 2010 elections, the group said.
"There is a real danger that Burma's generals will try to use Ban's visit to legitimize the 2010 elections," said Kenneth Roth, executive director of Human Rights Watch in a statement

UNITED Nations Secretary-General Ban Ki Moon and Singapore leaders on Thursday discussed the importance of engaging Myanmar, a day ahead of his planned visit to Yangon.

The UN chief, here on a two-day working visit, called on Prime Minister Lee Hsien Loong at the Istana and was hosted to dinner by Senior Minister Goh Chok Tong last night.

Singapore's Foreign Affairs Ministry said in a statement that PM Lee and Mr Ban exchanged views on the global economic crisis and discussed the UN chief's upcoming visit to Myanmar.

'PM Lee emphasised the importance of the continued engagement of the international community through the UN,' the statement said.

He also reiterated Singapore's 'support for the good offices of the UN Secretary-General and his Special Adviser Ibrahim Gambari's work on Myanmar'.

PM Lee and Mr Ban exchanged views on challenges facing the international community, including the economic crisis. At dinner, SM Goh discussed his recent four-day visit to Myanmar and Singapore's perspective on developments there.

'SM Goh emphasised the important role that the UN could play to help bring about national reconciliation in Myanmar by engaging all the stakeholders,' the statement said.

When SM Goh visited Myanmar last month, he urged its military government not to allow the ongoing trial of pro-democracy leader Aung San Suu Kyi to derail the national reconciliation process, and to ensure that national elections, to be held next year, are free and fair.

SM Goh said at the time that Myanmar's leaders understood the need to democratise, but they were being practical and doing it cautiously, step by step.

In March, PM Lee met visiting Myanmar Prime Minister Thein Sein and urged Myanmar to take bolder steps towards national reconciliation and engaging the international community. 'Singapore will do what we can, provided Myanmar considers this helpful,' he said at that time.

UN chief to lobby Myanmar for Suu Kyi's release

YANGON, Myanmar (AP) — The U.N. secretary-general said ahead of his trip Friday to Myanmar that he plans to lobby the military-ruled country's top leader directly for the release of pro-democracy leader Aung San Suu Kyi.
U.N. Secretary-General Ban Ki-moon was due to arrive in Yangon early Friday and then fly to the country's new administrative capital of Naypyitaw for meetings with leaders. Suu Kyi, currently on trial for allegedly violating terms of her house arrest, said Thursday she has not been informed of any plans for her to meet with Ban during his visit.
Ban told reporters traveling with him late Thursday that his talks would focus on gaining the release of all political prisoners including Suu Kyi; resumption of dialogue between the military government and its opposition; and creating conditions for credible elections.
He will meet with top junta leader Senior Gen. Than Shwe and Prime Minister Gen. Thein Sein.
"This is going to be, I know, a very difficult mission. But as the same time I know that to bring changes to Myanmar, political conciliation and democratization, we need to do our best," Ban told reporters while en route to Myanmar.
He said he would "convey the concerns of the international community, about the slow pace of political conciliation and democratization process."
"First of all I'm going to argue for the release of all political prisoners, including Aung San Suu Kyi," Ban said, adding that he would raise Suu Kyi's case directly with Than Shwe.
The secretary-general is also scheduled to meet leaders from Suu Kyi's National League for Democracy, other political parties and some ethnic minorities.
While some senior party members from the league have been informed that they will have an opportunity to meet Ban, a spokesman for the party, Nyan Win, told reporters there is "no indication" that he would meet Suu Kyi.
Suu Kyi said that if they did speak, she did not intend to discuss her current trial for violating the terms of her house arrest, he said.
Nyan Win, who is also one of her lawyers, said that Suu Kyi told her lawyers that her trial is not her priority, adding that "she's interested only in national reconciliation."
He added: "The U.N. Secretary-General ought to meet ... Aung San Suu Kyi in order to resolve Myanmar's political problems."
Suu Kyi, who has been in detention without trial for more than 13 of the past 19 years, is being held in Insein Prison while her trial is under way. If found guilty, she could be sentenced to five years in prison.
She was charged after an uninvited visitor, 53-year-old American John W. Yettaw, swam secretly to her lakeside house in May and stayed for two days. Final testimony in the case is expected Friday.
In Japan on Tuesday, Ban reiterated his call for the junta to free Suu Kyi and all of its estimated 2,100 political prisoners.
Associated Press writer John Heilprin contributed to this report from Singapore.

UN chief set for mission in Burma

Mr Ban has called for the release of all political prisoners
UN chief Ban Ki Moon will arrive in Burma shortly to seek the release of political prisoners including opposition leader Aung San Suu Kyi.
Mr Ban will hold talks with Burma's military leader Gen Than Shwe.
Ms Suu Kyi, a Nobel Peace laureate, has spent much of the past two decades in prison or under house arrest.
Her trial on charges of breaking the terms of her house arrest is about to resume after an interruption of more than a month.
Ms Suu Kyi's lawyers have been appealing against the judge's ban on testimony from three defence witnesses. One additional defence witness will now be allowed to testify.
International outrage
The trial of 64-year-old Ms Suu Kyi has caused outrage around the world.

Aung San Suu Kyi is head of the National League for Democracy party
Critics of Burma's military government have dismissed it as a ruse to keep the opposition leader locked up until after next year's election.
The BBC's Jonathan Head says Mr Ban's two-day visit is risky - coinciding with the resumption of Ms Suu Kyi's trial - but he is calculating he will get meaningful concessions from Burma's military rulers.
Although previous UN visits have been unsuccessful, it is possible the country's leaders are looking for a face-saving way out, and Mr Ban could be the person to deliver it, our correspondent says.
He has called for the immediate release of all Burma's political prisoners, thought to number more than 2,000.
"Through my meetings... I will convey exactly what the international community expects and wishes [regarding] the way they want to see changes in Myanmar [Burma]," he told reporters in Singapore before his departure.
The secretary general may be rewarded with the release of a small number, but our correspondent says that won't appease critics who argue he shouldn't be making this visit at all.
Suu Kyi request
It is not clear if Mr Ban will be allowed to meet Ms Suu Kyi, although he is due to meet members of her National League for Democracy (NLD) and other opposition activists.

HIGHLIGHTS OF THE NOON BRIEFING

BY MICHELE MONTAS

SPOKESPERSON FOR SECRETARY-GENERAL BAN KI-MOON

U.N. HEADQUARTERS, NEW YORK
Monday, June 29, 2009
SECRETARY-GENERAL TO VISIT MYANMAR
• At the invitation of the Government of Myanmar, the Secretary-General will visit Myanmar on 3 and 4 July.

• The Secretary-General looks forward to returning to Myanmar to address directly with the senior leadership a broad range of issues, including longstanding concerns to the United Nations and to the international community.

• In particular, the Secretary-General considers that three of the most important issues for the future of Myanmar cannot be left unaddressed at this juncture of the country’s political process. These are: the release of all political prisoners, including Daw Aung San Suu Kyi; the resumption of dialogue between the Government and Opposition as a necessary part of any national reconciliation process; and the need to create conditions conducive to credible elections.

• The Secretary-General also considers it important to consolidate and build on the joint humanitarian effort following his visit last year in the aftermath of Cyclone Nargis.

• The Secretary-General believes that the sooner these issues are addressed, the earlier Myanmar will be able to move towards peace, democracy and prosperity. He looks forward to meeting all key stakeholders to discuss what further assistance the United Nations can offer to that end.

• Asked if the Secretary-General will be meeting with Aung San Suu Kyi, the Spokeswoman said that Ban Ki-moon has asked to meet with all major stakeholders, including the detained opposition leader.

• Asked for the Secretary-General's reaction to the fact that witnesses for the defense in the ongoing trial of Aung San Suu Kyi were not allowed to testify, Montas reiterated the Secretary-General's earlier demand that all political prisoners, including Aung San Suu Kyi, be released.

• Montas, in response to a question on media participation in the trip, explained that the Secretary-General's trip was only confirmed this morning. She added that there was no formal invitation to correspondents because of the uncertainties surrounding the trip, and the small group of eight reporters selected came from a list of pending requests.

Is there a Burma-North Korea-Iran nuclear conspiracy?

Andrew Selth is a Research Fellow at the Griffith Asia Institute. He has recently returned from Burma and Thailand. If the Obama Administration was looking for another foreign policy challenge, all it would have to do is take seriously the rumours circulating in Thailand that Burma is pursuing a secret nuclear weapons program, with help from North Korea and Iran.

These stories have all the ingredients of a real security nightmare. The question is, are any of them true? In 2000, when Burma’s military government announced it was going to purchase a 10MW light water reactor from Russia, activist groups immediately warned that the generals were not to be trusted. They accused the regime of secretly planning to develop a nuclear weapon, to threaten the international community and resist pressures to reform.

The activists cited the regime’s long record of duplicity, its abiding fear of external intervention (particularly from the US) and its customary disregard for international norms of behaviour. They dismissed assurances that the reactor was for peaceful research, and would be placed under IAEA safeguards. Several Burmese officials claim direct knowledge, or even first-hand experience, of a secret nuclear weapons program.

Also, well before Naypyidaw and Pyongyang restored diplomatic relations in 2007, some observers (including a few high profile figures in Washington) expressed concern about Burma’s growing ties with North Korea, a known proliferator of nuclear weapons technology. At the time, these suspicions were greeted with scepticism. Burma had a long record of opposition to nuclear weapons proliferation.

Also, Burma’s financial reserves and its level of technological development were so low that many doubted its ability to build and manage a nuclear reactor, even with Russian assistance. But Burma’s military leadership was highly unpredictable, and prone to bizarre behaviour. And some generals clearly envied North Korea’s ability to use its nuclear weapons status to resist international pressure and wring concessions out of the US.

Still, no reliable evidence could be produced of a clandestine Burmese WMD program. As years passed, the Burma rumour mill ground on, prompting further accusations of the generals’ perfidy. There were reports in the news media and on the internet that thousands of Burmese were attending technical training courses in Russia, and that Burma was secretly receiving shipments of equipment from North Korea.

There were sightings of foreigners at defence establishments all around Burma. At the same time, there were increasingly strident claims by some activist groups, to the effect that Burma had constructed a reactor, developed uranium enrichment plants, and was exporting yellowcake to North Korea and Iran. A few even said that Burma already possessed nuclear weapons.

Yet the official view of Burma’s status remained unchanged. Throughout this period, the US issued numerous warnings about clandestine North Korean, Iranian and Syrian WMD programs but, as far as Burma was concerned, the Bush Administration remained conspicuously silent. In 2005 and 2006, for example, during its efforts to have Burma cited by the UN Security Council as ‘a threat to international peace and security’, the US pointedly made no reference to a Burmese nuclear weapons program.

In 2007, the State Department reminded Burma of its obligations under the nuclear Non Proliferation Treaty, but only referred to the proposed Russian reactor. For its part, the UK Government stated in 2006 that it was ‘not able to corroborate’ reports about the alleged transfer of nuclear technology from North Korea to Burma. The UK also put on record its view that no uranium was being processed in Burma, and that Burma did not have any operational enrichment facilities.

Nor was the UK aware of any Burmese uranium exports. In 2007, Singapore’s Foreign Minister said Burma was ‘unlikely’ to develop a nuclear program, given its many other problems. A new MoU signed by Burma and Russia that year revealed that construction of the research reactor had not even begun.

The most likely cause was a lack of funds. Over the past year or so, however, a number of governments have given this issue a higher priority. The increased level of interest seems to have been prompted by the appearance in Thailand of several Burmese officials (both civilian and military) who claimed to have direct knowledge, or even first-hand experience, of a secret nuclear weapons program.

According to these ‘defectors’, in 2002 Burma’s military government began building a reactor near Maymyo, with the aim of developing a nuclear device by 2020. The reactor and some related nuclear fuel processing plants were said to be hidden underground. The expertise for this project reportedly came from North Korea, with help from Iran and possibly Pakistan.

These claims are still to be verified. Some may in fact relate not to a secret WMD program, but to the regime’s efforts over the past 20 years to upgrade its military infrastructure. Particularly since the Iraq wars, Burma has felt vulnerable to attack from the air.

It has reportedly constructed underground command and control bunkers, hardened its communications nodes and built protective shelters for a range of new conventional weapon systems. The North Koreans have considerable expertise in making such facilities. Even so, both Western and regional governments now seem keen to find out whether the defectors’ claims are accurate.

Any suggestions of a secret WMD program, let alone one conducted by a pariah state like Burma, must be of concern. Some of the information provided by the defectors appears credible, and there are numerous defence facilities in Burma which have not been identified. Also, no-one underestimates the lengths to which the generals will go to stay in power, and to protect Burma from perceived external threats.

Understandably, however, foreign officials looking at these matters are being very cautious. No-one wants a repetition of the mistakes which preceded the last Iraq war, either in underestimating a country’s capabilities, or by giving too much credibility to a few untested intelligence sources. Particularly in the highly charged political environment that surrounds consideration of Burma’s many complex problems, no government is going to accept claims of a secret nuclear weapons program without investigating them thoroughly first.

There has always been a lot of smoke surrounding Burma’s nuclear ambitions. Over the past year or so, the amount of smoke has increased, but still no-one seems to know whether or not it hides a real fire. With this in mind, strategic analysts in many countries are looking to the Obama Administration for an authoritative statement on Burma’s nuclear status.

This may come sooner rather than later. The Burma JADE Act enacted by Congress last July stipulates that, within 180 days, the Secretary of State must issue a statement describing ‘the provision of weapons of mass destruction and related materials, capabilities, and technology, including nuclear, chemical, and dual use capabilities’. That deadline has already passed..

U.N. envoy discuss UN Chief visit

Myanmar FM, U.N. envoy discuss UN Chief visit
YANGON, June 28 (Xinhua) -- United Nations Secretary-General Ban Ki-moon's proposed visit to Myanmar has topped the discussions between his special envoy Ibrahim Gambari and Myanmar Foreign Minister U Nyan Win during Gambari's just-ended two-day visit to the country's new capital Nay Pyi Taw, local media reported Sunday.
However, neither of the two sides disclosed the specific date of Ban's visit, according to a report of the official newspaper New Light of Myanmar.
Gambari arrived on Friday and ended his visit on Saturday. No reports are available about the details of his meetings with high-ranking officials and political leaders in Myanmar.
Gambari's trip came amid the trial against Aung San Suu Kyi, her two maids -- Khin Khin Win and Win Ma Ma, and U.S. citizen John William Yettaw.
The trial was in connection with Yettaw's secret intrusion into Aung San Suu Kyi's then restricted lakeside residence on the night of May 3 by swimming through the Inya Lake. He was arrested at the dawn of May 6 when he was swimming back after having stayed there for two days.
Aung San Suu Kyi, General Secretary of the National League for Democracy (NLD), is charged with violating her terms of house arrest by accommodating Yettaw.
Despite lifting of the political leader's five and a half years' house arrest on May 26 for the third time, Aung San Suu Kyi continued to be detained to face the legal trial in this connection.
Along with Aung San Suu Kyi, the other three people are also being detained in the compound of Insein Prison, in Yangon, where the trial against them has been underway since May 18.
During his last four-day Myanmar mission from Jan. 30 to Feb. 3this year, Gambari met with Myanmar Prime Minister General Thein Sein and the government's authoritative team, led by Information Minister Brigadier-General Kyaw Hsan, in Nay Pyi Taw.
Arranged by the government, Gambari also met with Aung San Suu Kyi, 64, who was then under house arrest at her lakeside residence before the incident.
Gambari's just-ended mission was the eighth since he was appointed to the post in early 2006.
Meanwhile, Ban Ki-moon last visited the country in late May 2008 after it was struck by Cyclone Nargis early in the month which inflicted the heaviest casualties and massive infrastructure damage in a century mainly to Ayeyawaddy and Yangon divisions, claiming lives of 84,537 people and leaving 53,836 others missing and 19,359 others injured, according to official tally.

Do Not Forget Burma

Do Not Forget Burma
By Laura Bush
Sunday, June 28, 2009
For two weeks, the world has been transfixed by images of Iranians taking to the streets to demand the most basic human freedoms and rights. Watching these courageous men and women, I am reminded of a similar scene nearly two years ago in Burma, when tens of thousands of Buddhist monks peacefully marched through their nation's streets. They, too, sought to reclaim basic human dignity for all Burmese citizens, but they were beaten back by that nation's harsh regime.
Since those brutal days in September 2007, Burma's suffering has intensified. In the past 21 months, the number of political prisoners incarcerated by the junta has doubled. Within the past 10 days, two Burmese citizens were sentenced to 18 months in prison. Their offense: praying in a Buddhist pagoda for the release of the jailed opposition leader Aung San Suu Kyi. That is only the tip of the regime's brutality. Inside Burma, more than 3,000 villages have been "forcibly displaced" -- a number exceeding the mass relocations in genocide-racked Darfur. The military junta has forced tens of thousands of child soldiers into its army and routinely uses civilians as mine-sweepers and slave laborers. It has closed churches and mosques; it has imprisoned comedians for joking about the government and bloggers for writing about it. Human trafficking, where women and children are snatched and sold, is pervasive. Summary executions pass for justice, while lawyers are arrested for the "crime" of defending the persecuted.
Rape is routinely used as a "weapon of war." In 2006, I convened a roundtable at the United Nations to address the situation in Burma and listened as Burmese activist Hseng Noung described the rape victims she had aided. The youngest victim was 8; the oldest was 80. Her words silenced the room.
Yet time and again, the women of Burma, who are often the regime's chief targets, have responded to this brutality with inspiring courage. I will never forget visiting the remote and crowded refugee camps on the mountainous border between Burma and Thailand. There, I watched the tireless efforts of Dr. Cynthia Maung to provide lifesaving medical aid for hundreds of Burmese in need, many of them ill or injured. I sat with victims of land mines who had lost legs or feet and were waiting quietly, often for hours, for basic care. Last fall, it was my great privilege to present a Vital Voices award to Charm Tong, who testified before U.N. officials at the age of 17 and eloquently described the systematic military campaign of rape and abuse that is being waged against women in Burma's Shan state. She spoke unflinchingly even though her audience included representatives of the very regime she condemned.
More of us in America should make such courage our courage. At this moment, Aung San Suu Kyi, 64 and in fragile health, faces sentencing on trumped-up charges that could force her to endure five more years of brutal captivity. The junta leaders wish to undermine the Nobel Peace laureate's influence ahead of next year's elections. Leaders from around the world -- including the United States -- have called forcefully for the junta to release Aung San Suu Kyi and the 2,100 other political prisoners it is holding. Even Burma's closest allies in the Association of Southeast Asian Nations have called for her to receive proper medical care and have warned that Burma's "honor and credibility" are at stake. But the world must do more than express concern.
A new report from Harvard Law School asks the U.N. Security Council to establish a "commission of inquiry" into crimes against humanity and war crimes in Burma. Harvard's panel of international law experts has carefully catalogued what it deems as the junta's "widespread and systemic" human rights violations. The Security Council has already referred the crisis in Darfur to the International Criminal Court. It should do the same for Burma.
With U.N. Secretary General Ban Ki-moon planning to visit Burma this summer, it is crucial that he press the regime to take immediate steps to end human rights abuses, particularly in ethnic minority areas. There have been 38 U.N. resolutions condemning these abuses, yet the horrors continue unabated. Under the junta's brutal rule, too many lives have been wasted, lives whose talents could have helped all of Burma prosper.
But Aung San Suu Kyi's continued example of civil courage -- like those brave protesters in Iran -- reminds all of us that no matter how callous the regime, it cannot lock up what she stands for: the fundamental desire of all people to live in freedom and with dignity. During the brief moments that foreign diplomats were allowed to observe her show trial, Aung San Suu Kyi calmly apologized for having to greet them in a prison, saying, "I hope to meet you in better times." We should all share her hope -- and add our voices to those who risk so much to protest tyranny and injustice in Burma and beyond.
The writer is the former first lady of the United States.

Dear friends,
The Asian Human Rights Commission (AHRC) has previously reported on the case of two human rights lawyers who were sentenced to four months' imprisonment each for contempt of court, because they withdrew their powers of attorney on the wishes of clients who cited the reason as a lack of faith in Burma's judicial system. Now we regret to inform you that the licences of both lawyers have been revoked in a similarly unlawful manner.
CASE DETAILS
The AHRC has documented in detail the contempt of court case against and imprisonment of Supreme Court lawyers U Khin Maung Shein and U Aung Thein in September 2008 after they submitted letters to a court withdrawing their powers of attorney citing their clients statements that they had "no longer had faith in the judicial process". The judge attributed the statement to the lawyers rather than their clients and brought a charge of contempt against them. In November the two were found guilty without being able to defend themselves, and were sent to prisons far from their homes in Rangoon. They were released in March 2009.
In May the two rights lawyers were sent a copy of an order disbarring them from practice as lawyers. Ironically, the law revoked their licences under terms of a law that also should entitle them to tribunal hearings, and again, guarantees the right to present a defence in any disciplinary proceedings, which the two were denied.
Full details of the case are available at: http://campaigns.ahrchk.net/burma-lawyers Additional details also are contained in the sample letter, below.
BACKGROUND INFORMATION:
The AHRC has been documenting numerous cases speaking to what it has described as Burma's "injustice system" and Urgent Appeals on many of these can be accessed by going to the appeals' page and entering "Burma" into the search box: http://www.ahrchk.net/ua/search.php Two special reports have also been issued in the article 2 periodical, "Saffron Revolution imprisoned, law denied" (vol. 7, no. 3, September 2008) and "Burma, political psychosis and legal dementia" (vol. 6, no. 5-6, December 2007).
There are also a number of related sites, including the AHRC Burmese-language blog, Pyithu Hittaing, and the most recent campaign page on lawyers imprisoned for attempting to defend their clients: http://campaigns.ahrchk.net/burma-lawyers/

SUGGESTED ACTION:
Please write to the persons listed below to call for a review of the procedure to revoke the two lawyers' licences. Please note that for the purpose of the letter, the country should be referred to by its official title of Myanmar, rather than Burma, and Rangoon should be Yangon.
Please be informed that the AHRC is writing a separate letter to the UN Special Rapporteurs on Myanmar and independence of judges and lawyers as well as the UN Special Representative on human rights defenders, and the regional human rights office for Southeast Asia, calling for interventions into this case.
SAMPLE LETTER:
Dear ___________,
MYANMAR: Revocation of lawyers' licences not in accordance with law
Lawyers whose licences revoked:
1. U Aung Thein, Advocate No. 2703, residing in Ward 8, Thingangyun Township, Yangon
2. U Khin Maung Shein, Advocate No. 4660, residing in Bogone Ward, Insein Township, Yangon
Under: Supreme Court Order No. 46/2009, signed by Than Myaing, Director; dated 15 May 2009
I regret to learn that after four months' unjust and illegal imprisonment, two Supreme Court advocates in Myanmar have had their licences revoked, and I call on you to review the allegations against them and reinstate their rights to practice law.
Briefly, I am aware that U Aung Thein and U Khin Maung Shein are both advocates of long experience who in 2008 were representing many defendants in criminal cases arising from the protests of September 2007, including the defendants in Felony Nos. 307-311/2008 before Judge Daw Aye Myaing of the Hlaing Township Court. At the hearing of 6 October 2008 one of the defendants, speaking on behalf of the others, informed the court that as they "no longer had faith in the judicial process" that they would withdraw the power of attorney from the two lawyers. At the hearing of October 20 Khin Maung Shein in the courtroom gave the submissions to withdraw power of attorney. The defendants read the documents thoroughly and each signed them. The two attorneys also had their signatures affixed. Then the documents were submitted to the court. At that time the judge said that the remark that the defendants "no longer had faith in the judicial process" had not been made orally at the earlier hearing and said that the lawyers had themselves inserted it.
The Hlaing Township Court then made an application to the Supreme Court under section 3 of the Contempt of Courts Act, 1926, that, contempt of court may be punished with imprisonment for a term that may extend to six months, in Miscellaneous Criminal Application No. 99/2008, Daw Naw Than Than Aye applicant. The aforesaid act has no provisions in it at all to define the circumstances or manner in which contempt may be proven or otherwise.
On 6 November 2008 the Supreme Court found the two advocates guilty of contempt of court and sentenced them to four months' imprisonment each, despite its own apparent uncertainty about what had transpired.
After their release on 6 March 2009, the two lawyers went back to work but on 15 May 2009 they were sent copies of Supreme Court Order No. 46 /2009, disbarring them from practice.
Ironically, the order dismissing them from service cited section 10(1) of the Bar Council Act 1926, authorizing the court to remove lawyers found guilty of misconduct. The same law also very clearly lays down the procedure for holding a tribunal to investigate misconduct prior to suspension or removal, including, in section 12(3), that the court shall inform the accused advocate of the date of hearing and "shall afford the advocate concerned... an opportunity of being heard before orders are passed in the case". None of that happened in this case.
I urge the authorities in Myanmar to review as a matter of urgency the revoking of these two lawyers' licences, with a view to reinstating them to the profession or at very least affording them the fair hearing to which they are undeniably entitled but have so far been denied.
Yours sincerely
