ASEAN urged to form human rights court
A coalition of 70 Asian NGOs called on ASEAN countries Tuesday to create a regional human rights court, amid criticism over the grouping's failure to form a powerful rights commission and to push Myanmar to free Nobel laureate Aung San Suu Kyi.
The Solidarity for Asian People's Advocacy Task Force on ASEAN and Human Rights (SAPA-TFAHR) said it had sent an open letter to the high-level panel tasked with drafting the political declaration to the terms of reference (TOR) of the ASEAN Inter-Governmental Commission for Human Rights.
ASEAN recently approved the terms of reference establishing the first-ever human rights commission in the region, which has been widely criticized as powerless and even accused of being no more than "window dressing" for the organization once dubbed an exclusive club of dictators.
Indonesia, one of the only two full-fledged democracies in the region, secured commitments from other countries to sign a political declaration in return for its endorsement of the terms of reference it had earlier strongly opposed.
The declaration will provide a mandate that the rights commission, slated to be officially established in October, will be reviewed every five years.
The ASEAN panel will convene in Jakarta from Aug. 26 to 27.
In their letter, the NGOs said they demanded the regional grouping establish within 10 years a full-fledged regional human rights mechanism, whose standards they said had to be on a par with those of the mechanisms in other regions such as Africa and Europe, which already had rights courts.
"The evolution to develop protection mandates and a full-fledged human rights mechanism may take 100 years, or 10 years, or less," Indonesia's Rafendi Djamin, who co-signed the open letter to the ASEAN panel, said at a press conference in Jakarta.
"We're saying let's set a time frame, the sooner the better, but *it* should be no more than 10 years."
Sinapan Sammydorai, from the Think Center Singapore, said ASEAN countries must set a clear timeline for their human rights agenda, as they did when they decided to make the region a single market by 2015.
Honey Tan, from the ASEAN Women's Caucus, said although the political declaration was merely a declaration and therefore nonbinding, it could be used as an indicator to measure the improvements made by ASEAN.
She said the current TOR to the rights commission "lacked clarity" and "mostly contradict each other".
She also highlighted the fact the TOR did not specifically mention the concept of equality in its principle section, and instead used "negative statements" such as "avoidance of double standards" and "avoidance of politicization".
"If we want to say equality, *then* say equality; don't put it in the negative," she said.
Chalida Tajaroensuk, from Thailand's People's Empowerment Foundation, said the declaration "will serve as a guideline for the direction of the commission in the future.
In the next five years there will be an amendment to the TOR and we hope the protection elements can be included."

Burmese junta attacks on Burma Democratic Concern (BDC)
Burmese military junta is explicitly attacking Burma Democratic Concern (BDC) on their mouth-piece newspapers as well as doing smear campaign against us. Junta’s stooges are everywhere and we must be vigilant at all time as junta hide its moles every corners of the world.
Junta’s notorious tactics is divide and rule.

Compassionate Release Will not Occurs in Burma ?
A lot of people worldwide are shocked to know that Abdelbaset Ali al-Megrahi, 57, was released based on compassionate ground. Megrahi was jailed in 2001 for blown up the PAN-AM 103 jet plane which claimed 270 lives in 1988. Scottish Justice Secretary Kenny MacAskill made a decision that the Libyan, who has terminal prostate cancer, would be allowed to return to his homeland. Among the dead were 189 Americans. Americans are very upset about the Scott’s decision because innocent people were killed in this incident.
Unlike Scotland , the Burmese regime has an opposite attitude. The Burmese opposition leader Aung San Suu Kyi’s husband, the British academic Michael Aris had terminal prostate cancer like Megrahi have. Michael requested to visit Burma to see his lovely wife Aung San Suu Kyi for one last time, before he died. But the Burmese authorities denied his visa application. Three months later Michael died without fulfill his last wish.
The Scottish judge’s decision is based on his religious belief that even though the Libyan man killed 270 lives, he has to release him based on forgiveness as well as compassionate understanding which allowed the murderer to rejoin with his family before his last breath.
On the other hand, the Burmese generals do not understand compassionate release to Burmese most beloved opposition leader Aung San Suu Kyi, who did not kill any one. She is the one who choose non violent means and her goal is to change Burma as democratic state. Her upper Burma organizational trip was ambushed by the government sponsored criminals and nearly hundred of her followers were beaten to death. She luckily escaped from being murdered. No one was captured for the massacre known as Depeyin Massacre but the regime put her under house arrest and claimed her life was in danger that was the reason they put her house arrest. The regime let the attackers free but the one who was attacked was put under house arrest. This kind of unlawful act clearly proved that people who committed crimes are now ruling Burma and innocent people were systematically thrown into jail.

Unlike Scotland , the Burmese regime has an opposite attitude. The Burmese opposition leader Aung San Suu Kyi’s husband, the British academic Michael Aris had terminal prostate cancer like Megrahi have. Michael requested to visit Burma to see his lovely wife Aung San Suu Kyi for one last time, before he died. But the Burmese authorities denied his visa application. Three months later Michael died without fulfill his last wish.
The Scottish judge’s decision is based on his religious belief that even though the Libyan man killed 270 lives, he has to release him based on forgiveness as well as compassionate understanding which allowed the murderer to rejoin with his family before his last breath.

The Swimmer Speaks
How was a retired bus driver from Missouri able to make a flipper-clad, two-kilometer swim to the heavily guarded house of Burmese pro-democracy leader Aung Sang Suu Kyi, one of the world's most famous dissidents? While John Yettaw languished in Burmese jail during his trial for "illegal swimming," all we could do is speculate. But now, in an exclusive interview with NEWSWEEK, Yettaw has offered an explanation: Burmese security officials let him. "I don't know why they didn't stop me," he says. "The man with the AK-47 shook my hand and let me in."
In his first full-length interview, conducted by telephone from his home in central Missouri, Yettaw addressed the rationale for his undiplomatic dip, responding to critics and speaking at length about his commitment to Burma. "I want to free Myanmar. I want to stop the suffering there. I am antijunta. I will never be at peace, emotionally or psychologically, until that woman is free, until that nation is free," he said.
Yettaw burst onto the front pages of the world's papers in May, when he had made an uninvited two-day visit to the home of Suu Kyi. "The Lady," as locals call her, trounced opponents in the country's last open election in 1990, but the junta refused to recognize the results and has kept her under arrest for 14 of the past 20 years for trying to topple the regime. She was due to be released on May 27, just weeks after Yettaw showed up, well ahead of next year's landmark national elections—the first in two decades. But earlier this month, Suu Kyi was sentenced to 18 more months of home confinement. On Sunday, Yettaw was freed from seven years of hard labor when U.S. Sen. Jim Webb negotiated for his release; he was deported back to the United States.
A quixotic man who didn't have a passport until last year, Yettaw is an unlikely protagonist on the international political stage. The junta believes that antigovernment activists used Yettaw to embarrass its leaders, while Suu Kyi's supporters say that the government used the American as a pretense for keeping their best-known critic under house arrest rather than risk igniting the opposition ahead of the 2010 elections. Yettaw's family, for its part, doesn't know what to believe. After years of questions that have gone unanswered and behavior that doesn't quite add up, they have come to accept Yettaw the way he is—bighearted but unsteady—without asking too many follow-ups.
Late Thursday night, the 53-year-old Missourian remained an enigmatic figure, failing to clarify lingering questions and offering rambling and occasionally contradictory responses. "I have to be careful what I say or it will hurt the people of Myanmar," he explained, using Burma's other name. Echoing his court testimony, he says he traveled to Burma hoping to visit the Nobelist Suu Kyi—and to warn her that he'd learned, in a divine vision, terrorists were planning to assassinate her. He denied that the military junta ruling the country had put him up to the visit. "I've been accused of being CIA, of being on the books of the junta. The idea is just ridiculous," he said.
Still, the question remains: why didn't guards stop Yettaw as he made his way across the lake to the home of the country's most famous prisoner? Yettaw had made a similar aquatic bid for the Suu Kyi house in November 2008, but he was turned away by her on-site companions. He told family that he had been captured by guards at gunpoint on his way back from her house. The guards, he says, apparently unaware of his first attempted visit Suu Kyi's house, bought his story that he had fallen into the lake while fishing and let him go.

အခန္းတစ္ခန္းအား ျမန္မာ ဘာသာသို႔ ျပန္ရျခင္း ျဖစ္သည္။ “ပဲခူး ကေ၀”
ကေလာင္အမည္ႏွင့္ ကိုေအာင္ဆန္း၀င္ၿပိဳင္၏။ ကိုေအာင္ဆန္း ၏ စာမူအား

နိဂံုးခ်ဳပ္ထား၏။ ၁၉၃၅ခုႏွစ္ တကၠသိုလ္ ေက်ာင္းသား ကိုေအာင္ဆန္း၏
အေတြြးအျမင္ျဖစ္၏။ ေတာ္လွွန္ေသာစာ။ သူပုန္ဆန္သည့္ အေတြြးဟုပင္

Obama Reaffirms U.S. Stance on Burma
Unimpressed by “Webb’s Folly” *US President Barack Obama held firm America’s position on sanctions to the criminal regime of Burma. Though he was pleased that John William Yettaw was released from prison this did not influence US policy with the criminal regime of Burma. Sanctions will remain until the junta actually shows signs of reconciliation which include the release of Daw Aung San Suu Kyi and the 2,100 political prisoners.
The White House has maintained an open door policy with the junta of Burma if Than Shwe was of the mind to do so. Opportunities lay just around the corner if the military junta actually wanted their nation to prosper, there is no question. True reconciliation would be the difference between night and day for the lives of 50,000 people. Than Shwe’s generals would not need false passports to travel around the world. The regime as a whole would not have to live as exiles in the global community. With a wealth of natural resources of a wide variety Burma would be restored to the bustling hub of commerce it once was. Maybe Tay Za would be able to drive one of his fancy sports cars on the Autobahn rather than some dingy parking lot or airport runway.
But at least it is comforting to know President Barack Obama has not wavered on the US commitment to democracy and human rights in Burma. And for this I am very thankful to America’s president for he showed true leadership on this issue.

Through her attorney Nyan Win, Aung San Suu Kyi’s stance on sanctions has not changed since 2007. When poised with remarks in a British newspaper that she was considering lifting the tourism embargo in Burma, she simply said no one has spoken to her about it at all. This quite a contrast to the remarks made by US Senator Jim Webb when he clearly stated;
“I don’t want to misrepresent her views, but my clear impression is that she is not opposed to the lifting of some sanctions,”
Further, during Webb’s visit with Daw Aung Suu Kyi it was all too apparent he was more interested in China’s growing “Fearful Influence” in Burma. Aung San Suu Kyi found Webb’s “fearful influence offensive and offered a rebuttal to his terminology in reference to China. Clearly Senator Webb was referring to China’s pipeline and other vested interests in the region. It should also be noted that Webb has opposed sanctions and promoted commerce with the criminal regime claiming sanctions have failed. The reality is sanctions have not been honored by many nations including the US and UK. India’s Tata Motors, the parent company of UK’s Land Rover and Jaguar, is building a heavy truck plant in Burma to facilitate Than Shwe’s military needs. Tata is also heavily invested in Briton making the UK an unwitting partner in genocide, if you think about it. The list of countries and corporations who are lining the pockets of Than Shwe’s criminal regime is staggering. So the notion sanctions have not worked is ludicrous since true sanctions have not been honored from the very beginning, just lip service.
Now Webb is going to report to US Secretary of State Hillary Clinton with his “facts”. The one fact still remains; Daw Aung San Suu Kyi maintains her and the National League for Democracy’s position on all points including sanctions and true reconciliation. She maintained that she has always kept the door open for dialogue with the regime.
Now, that the junta successfully placed Aung San Suu Kyi out of the running for the sham 2010 election. Reconciliation and the democratic process have been replaced with the bogus roadmap to nowhere by the regime. Than Shwe’s 7 Steps have obviously stepped backwards. The United Nations has proven to be as impotent as ever as they have more meetings and review tons of eye witness accounts of genocide and crimes against humanity. Burma continues to be placed at the back of the line while the world addresses recent acts of genocide and human rights violations in other parts of the globe.
It was ironic that while Jim Webb was making nice with the regime 10,000 residence in Sham State evacuated to China, thousands of Karen fled with their lives. Rape and murder continue to be the signature of Than Shwe’s Burmanization Program as genocide continues unabridged by the international community. It’s all about the money anyway, why fool ourselves. If it’s not profitable it’s not worth fighting for. Morality and ethnics has no place in current society, only the corporate bottom line. With the edict of Economics over Humanity it is clear help for Burma will not come from the outside world. The cries of the innocent will continue to fall on deaf ears and the world will continue to walk in the shadow of cowards and false hopes. The fate of Burma rests in the hands of the courageous and it is up the people to reawaken the Fighting Peacock for they are truly alone.
Senator Jim Webb’s visit to Burma has been hailed as a major coup for the criminal regime. The junta’s propaganda machine has hailed Webb’s meeting as a major milestone in renewing relations with Burma. But in all reality it was a major blow to the democratic movement and a big win for the junta. Webb gave the green light to the continued wholesale murder of the ethnic minorities within Burma as well as the continued arrests of all political opposition. And that’s the bottom line.

The swimmer is free: Who is really guilty?
Mr. John William Yettaw, the man who caused all the troubles for Aung San Suu Kyi this recent months, has been released from prison and has now left Burma for good.
He is now free after the evil and murderous Burmese Junta accepted the plea of United States Senator Jim Webb to release him during his visit to the country. He was first sentenced to seven years' hard labour but Mr Yettaw will now be going back to Missouri, USA.
Last Tuesday, Aung San Suu Kyi was convicted by an unfair and sham "special" court in Rangoon for "breaking" the terms of her house arrest.
The sentence for her was originally three years' hard labour, which shocked diplomats who were present in the trial, but they said that the only thing that she did was just smile.
After a dramatic silence, the Interior Minister went inside the court and read out a special order from the head of the military regime, Than Shwe, that instructed that Daw Suu's sentence was to be now commuted to 18 months under house arrest.
Another year and a half behind bars in her own home: She won't be able to take part in the national elections scheduled by the junta for next year, unless she is released (which is, I think, only has a tiny chance for it to happen...)

Although the commuting of the sentence gave a sigh of relief for supporters of Daw Suu, it still angered many people all over for the unfair judgement on her, which began another chain of protests and condemnations across the globe.
Many, including myself, have been asking: WHO IS REALLY GUILTY? Aung San Suu Kyi, the woman who has inspired millions for her courage and calmness, or Senior General Than Shwe and the junta, the men in the green uniform, army maniacs hated by their own people, because of the horrible atrocities that they have done to their countrymen.
After comparing these two people that have influenced the lives of the People of Burma, I'm sure that we all know who really is guilty.
